Item 7.01 Regulation FD


On June 28, 2021, we issued a press release addressing an appeal filed in Alaska Superior Court by Earthjustice of the decision by the Commissioner of the Alaska Department of Environmental Conservation (ADEC) to uphold the state’s Clean Water Act 401 Certification (the “401 Certification”). Earthjustice filed the appeal on behalf of Orutsararmiut Native Council (ONC) on June 28, 2021. The 401 Certification was originally granted for the Donlin Gold project on August 10, 2018. A copy of the press release is furnished as Exhibit 99.1 to this report and incorporated herein by reference.
